IMPORTANT — PLEASE READ CAREFULLY: By accessing or using AiSkillsGuard, you agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using the Service. These terms contain limitations of liability and disclaimers of warranties that significantly affect your legal rights.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Panam Leishangthem, operating as AiSkillsGuard ("we", "us", "our"), governing your access to and use of the security scanning service available at www.aiskillsguard.com and all associated APIs, tools, and content (collectively, the "Service").

By using the Service in any manner, you represent that: (a) you are at least 16 years of age; (b) you have the legal capacity to enter into binding contracts in your jurisdiction; (c) you are not prohibited from using the Service under any applicable laws; and (d) if you are using the Service on behalf of an organisation, you have authority to bind that organisation to these Terms.

2. Description of Service

AiSkillsGuard provides an AI-powered security analysis service that allows users to submit AI agent skills, Model Context Protocol (MCP) server configurations, plugins, and similar files or code for automated security risk assessment. The Service:

Analyses submitted content using static pattern matching and AI language model analysis
Generates risk scores, security findings, permission analysis, and safety recommendations
Accepts input via direct text paste, file upload, and URL fetching
Provides results in plain-English format intended to assist users in making informed installation decisions

3. Critical Disclaimer — Nature and Limitations of the Service

THE FOLLOWING LIMITATIONS ARE FUNDAMENTAL TO UNDERSTANDING WHAT AISKILLSGUARD IS AND IS NOT. READ THIS SECTION CAREFULLY BEFORE RELYING ON ANY SCAN RESULTS.

3.1 Not a Security Guarantee

AiSkillsGuard is a risk reduction and awareness tool. It is NOT a comprehensive security guarantee. A "Safe" or low risk score result does NOT mean a skill is definitively safe to install. A "Critical" result does NOT definitively mean a skill is malicious. All results are probabilistic assessments based on available information at the time of scanning.

3.2 Known Limitations

The Service cannot detect threats embedded in compiled binaries, minified code, or obfuscated payloads beyond pattern recognition capabilities
Server-side malicious behaviour that is not reflected in the submitted code cannot be detected
Zero-day attack techniques that postdate our detection patterns may not be identified
The AI analysis model (Anthropic Claude) may produce false positives (incorrectly flagging safe code) or false negatives (missing malicious patterns)
The Service analyses only the submitted content — it cannot assess the reputation, identity, or trustworthiness of the skill author
Our detection patterns are current as of our last update and may not reflect the most recent threat landscape
URL-fetched content may differ from the version actually installed from a registry

3.3 Not a Substitute for Professional Security Review

The Service is not a substitute for professional cybersecurity assessment, code auditing, or expert security review. For production, enterprise, or high-stakes environments, you should engage qualified security professionals in addition to using this Service.

3.4 User Responsibility

You remain solely responsible for all decisions made based on Service results, including but not limited to decisions to install, run, share, or reject any AI agent skill or plugin. AiSkillsGuard expressly disclaims responsibility for any consequences arising from your use or non-use of any skill, regardless of the scan result provided.

4. End User License Agreement (EULA)

4.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business security assessment purposes.

4.2 License Restrictions

You may NOT:

Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission
Attempt to reverse engineer, decompile, disassemble, or discover the source code of our proprietary detection systems or prompts
Use the Service to build a competing security scanning product or service
Automate access to the Service in a manner that exceeds normal human usage without prior written consent
Use the Service to scan content you do not own or have rights to submit for analysis
Circumvent any rate limits, access controls, or security measures
Use the Service in any way that violates applicable laws or regulations
Frame, mirror, or embed the Service without written permission
Misrepresent scan results or use them in misleading marketing or communications

4.3 Acceptable Use

The Service may only be used for lawful purposes including:

Security assessment of AI agent skills before personal installation
Security assessment of skills you or your organisation are considering deploying
Security research and education
Due diligence assessment of third-party AI tools

5. User Submissions and Content

5.1 Your Responsibility for Submitted Content

You are solely responsible for all content you submit to the Service. By submitting content, you represent and warrant that:

You have the right to submit such content for analysis
The submitted content does not violate any third-party intellectual property rights
The submitted content does not contain your personal credentials, private API keys, passwords, or sensitive personal information of others
You are not submitting content for the purpose of probing, testing, or attacking our infrastructure

5.2 Third-Party AI Processing

You explicitly acknowledge and consent that submitted content will be transmitted to Anthropic's Claude API for analysis. You accept Anthropic's terms of service and privacy policy in connection with such processing. We are not responsible for Anthropic's handling of submitted content.

5.3 No Sensitive Data

Do not submit content containing: personal passwords, private cryptographic keys, personally identifiable information of third parties, financial account numbers, health information, or any data classified as sensitive under applicable law. We expressly disclaim liability for any consequences arising from your submission of such data.

6. Intellectual Property Rights

6.1 Our Property

The Service, including its name, logo, detection algorithms, system prompts, analysis methodology, software, design, and all related intellectual property are owned by Panam Leishangthem and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

6.2 Feedback

If you provide suggestions, feedback, or ideas regarding the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation to you.

6.3 Scan Results

Scan results generated by the Service are provided to you under the license granted in Section 4.1. You may share individual scan results for legitimate security awareness purposes but may not commercialise or systematically harvest scan results to build competing datasets or products.

7. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
SCAN RESULTS WILL BE ACCURATE, COMPLETE, OR RELIABLE
THE SERVICE WILL DETECT ALL MALICIOUS PATTERNS OR THREATS
ANY DEFECTS IN THE SERVICE WILL BE CORRECTED
THE SERVICE IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS
RESULTS WILL MEET YOUR SPECIFIC SECURITY REQUIREMENTS

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Panam Leishangthem,AiSkillsGuard, ITS OPERATORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS
DAMAGES ARISING FROM YOUR INSTALLATION OR USE OF ANY AI SKILL BASED ON SCAN RESULTS
DAMAGES ARISING FROM MALWARE, DATA BREACHES, OR SECURITY INCIDENTS INVOLVING SCANNED SKILLS
DAMAGES ARISING FROM INACCURATE, INCOMPLETE, OR ERRONEOUS SCAN RESULTS
DAMAGES ARISING FROM THIRD-PARTY AI PROCESSING OF YOUR SUBMITTED CONTENT
ANY MATTER BEYOND OUR REASONABLE CONTROL

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) USD $10 (TEN US DOLLARS).

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY.

CERTAIN JURISDICTIONS (INCLUDING EU MEMBER STATES AND THE UK) DO NOT ALLOW EXCLUSION OR LIMITATION OF LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION. NOTHING IN THESE TERMS SHALL LIMIT OUR LIABILITY IN SUCH CASES.

9. Indemnification

You agree to indemnify, defend, and hold harmless Panam Leishangthem, AiSkillsGuard, and their respective officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any applicable law or regulation
Content you submit to the Service
Your installation or use of any AI skill based on Service results
Any claim by a third party arising from your use of the Service

10. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update the detection patterns, AI models, scoring methodology, and features at any time without notice. Such updates may affect scan results for the same content submitted at different times.

11. Payments and Subscriptions (When Applicable)

Paid plans are billed in advance on a monthly or annual basis via Stripe
All fees are non-refundable except as required by applicable consumer protection law
EU and UK users have a 14-day right of withdrawal for digital services unless the service has begun with your explicit consent
We reserve the right to change pricing with 30 days notice to active subscribers
Failure to pay may result in immediate suspension of paid features
You are responsible for all applicable taxes in your jurisdiction

12. Consumer Rights — EEA and UK Users

If you are a consumer resident in the European Economic Area or United Kingdom, you may have additional rights under applicable consumer protection law that cannot be excluded by contract, including:

Rights under the EU Consumer Rights Directive and national implementing legislation
Rights under the UK Consumer Rights Act 2015
14-day right of withdrawal for digital content and services (subject to exceptions)
Rights to conformity of digital services
Protection against unfair contract terms under the EU Unfair Contract Terms Directive

Nothing in these Terms is intended to limit any rights you have under applicable mandatory consumer protection law in your country of residence.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. For users in the EEA, mandatory provisions of your country of residence's law shall apply. For users outside the EEA, these Terms are governed by the laws of the jurisdiction where the operator resides.

13.2 Dispute Resolution

We encourage you to contact us first at legal@aiskillsguard.com to resolve any dispute informally. If informal resolution fails:

EEA users may use the EU Online Dispute Resolution platform: ec.europa.eu/odr
UK users may refer disputes to an approved Alternative Dispute Resolution (ADR) provider
For other users, disputes shall be resolved through binding arbitration or the courts of competent jurisdiction

14. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

You may stop using the Service at any time. If you have a paid subscription, contactlegal@aiskillsguard.com to cancel. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 6, 7, 8, 9, and 13.

15. Third-Party Links and Services

The Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. Your interactions with third-party services are governed by their respective terms and privacy policies.

16. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, internet infrastructure failures, third-party service outages (including Anthropic API, Supabase, or Vercel), or other events beyond our reasonable control.

17. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AiSkillsGuard regarding the Service and supersede all prior agreements, representations, and understandings.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date and, where appropriate, by email notification to subscribers. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
